Residency Obligation Appeal
When a permanent resident is outside Canada and has lost their PR status due to a breach of residency obligation, they may appeal to the Immigration and Refugee Board (IRB). The appeal rules whether they have breached their obligation. If the appeal on residency obligation is allowed, the IAD will overturn the original decision and the person will keep his or her permanent resident status. If the appeal is dismissed, the person will lose permanent resident status.
